Could i sue the hospital?
I went in for a endoscopy on my pancreas a few months ago, and i received a registered letter in the mail saying the equipment was not cleaned properly and I would have to go in and get a test to check for hepatitis and HIV, isn't this negligence on their behalf? Could i sue them? I live in Canada if that makes a difference, and there were about 400 others that got the same letter, and 1 person has died from contracting something from the machines.
I don't know about in Canada, but first you should have the tests. If they are positive, you would probably have grounds for a suit. But be prepared to face questions about your personal and sex life because they will try to prove you already had the diseases. If it's negative, you do have some days of worry to go through (or months), but that usually isn't worth much in the malpractice game.
You could talk to an attorney, probably for free, about this to confirm your rights in Canada. There is usually a deadline, so you should also ask the lawyer what that is, for filing suit.
